Privacy Policy

This Privacy Policy (hereinafter the “Policy”) regulates relations in the field of protection of personal data of visitors of the website rescuenow.ngo (hereinafter the “Website”) owned by CHARITABLE ORGANIZATION CHARITABLE FOUNDATION RESCUE NOW, EDRPOU code 44727134, registered address: 60 Promyslova Str., Letter B-3, Room No. 1, Shevchenkivskyi district, Lviv, 79024, registered under the effective laws of Ukraine (hereinafter the “Foundation”).

1. GENERAL PROVISIONS

  1. In this Policy, the following terms are used:

• personal database means a named set of organised personal data in electronic form and/or in the form of personal data files;

• consent of the personal data subject means voluntary expression of the will of a natural person (provided that he/she is informed) regarding the granting of permission for the processing of his/her personal data in accordance with the formulated purpose of their processing, expressed in a form that makes it possible to conclude that consent has been given;

• personal data processing means any operation or set of operations such as collection, registration, accumulation, storage, adaptation, alteration, updating, use and dissemination (distribution, sale, transfer), depersonalisation, destruction of personal data, including with the use of information (automated) systems;

• personal data mean information or aggregate information about a natural person who is identified or may be identified;

• personal data subject means an individual whose personal data are processed;

• third party means any person, with the exception of the personal data subject, the controller or administrator of personal data;

• cookies mean small text files stored in the browser of the device (computer, mobile phone, etc.) after visiting the Website, which the Website transmits to the browser.

All other terms in the Policy are used in the meanings defined by the effective laws of Ukraine, including international regulations ratified in Ukraine.

1.2. This Policy has been developed to inform personal data subjects about the procedure for processing their personal data when visiting/using the Website, as well as to ensure the protection of their personal data during such processing.

 1.3. This Policy, as well as activities of the Foundation related to the collection, processing, storage and other lawful actions regarding personal data are regulated by:

  • the Constitution of Ukraine;
  • Law of Ukraine No. 2287-VI dated 1 June 2010 “On Personal Data Protection”;
  • other valid regulations of Ukraine governing the matter of personal data protection;
  • international regulations ratified in Ukraine.

The law (including international), national and international regulations governing the protection of personal data of residents of such countries also apply to legal relations that arise in the Foundation in connection with the processing of personal data of residents of foreign jurisdictions.

1.4. The controller of personal data processed in connection with visiting/using the Website options is the Foundation. The Foundation has the right to fully or partially entrust personal data processing to third parties on the basis of an agreement concluded in accordance with the requirements of the effective laws.

1.5. A natural person is a personal data subject according to this Policy if he/she is a visitor to the Website, including if he/she uses any of the options available on the Website.

1.6. The Foundation guarantees that it:

  • adheres to good practice and regulatory requirements for the personal data protection;
  • protects the rights of personal data subjects;
  • prevents the risk of violation of the security of personal data processing.

1.7. The purpose of processing personal data obtained during the functioning of the Website is the implementation by the Foundation of its statutory activities.

1.8. The posting of this Policy is a notification to the personal data subjects about the Controller, the composition and content of personal data collected in connection with visiting/using the Website, about the rights of such subjects, the purpose of collecting their personal data and third parties whom such personal data may be transferred.

2. PERSONAL DATA PROCESSING

  1. The Foundation may collect and process the following information about you:

• Information you provide to the Foundation: this is information about you that you provide by: using the Website and Website options, signing up to receive updates to email, providing charitable assistance (donations) using the Website options, communicating with the Foundation through the options available on the Website, etc.

• Information about you collected by the Website and other systems:

1) if you visit the Website, third parties may collect certain information about you and your visit, such as the type and version of your browser, as well as the Website pages you visit, the Internet Protocol (IP) address;

2) the Website may also download cookies to your device;

3) if you contact the employees of the Foundation using the Website or other electronic communication means.

• Information that third parties collect about you on the Website by performing actions: this is information about you that you provide to third parties (for example, Facebook, Google, Twitter) by using the social media sharing options available on the Website, when you navigate from one page to another or by viewing materials with links to (opening) other platforms (websites).

2.2. How the Foundation processes your personal data depends on how you use and interact with the Website. Some information may be provided directly by you while using the Website or otherwise; other information may be collected and processed by the Foundation independently using automated technologies used on the Website.

2.3. Legal grounds for data processing: when visiting the Website, the Foundation processes your personal data if:

1) the Foundation has received your consent to such processing;

2) your personal data are necessary for the Foundation to conclude and execute a transaction with you or to carry out measures preceding the conclusion of a transaction;

3) in cases where the Foundation has a legitimate interest in processing your personal data, and such legitimate interest does not prevail over your interests in data protection or your fundamental rights and freedoms;

4) in other cases determined by the effective laws. In some cases, the Foundation may have a legal obligation to process your personal data or will process your personal data to formulate, make or defend legal claims.

2.4. Automated processing mechanisms: The Foundation and third parties may use automated information processing technologies to process information in some sections of the Website. The Foundation uses cookies to store content and settings, which allows the Foundation to process standard information your browser sends to certain websites you visit, such as your IP address, browser type and language, and the site you came from, the pages you visit and the links you click on the Website. The availability of such technical information helps the Foundation to improve the Website.

2.5. The Foundation may use your personal data only with the aim and for the purposes defined by this Policy and the effective laws, in particular (but not limited to):

1) in order to process your request (appeal) to the Foundation made using the Website;

2) in order to ensure that you provide charitable assistance (donations) using the options available on the Website;

3) in order to implement other statutory goals of the Foundation in accordance with the procedure determined by the effective laws.

2.6. The Foundation may accumulate personal data processed during your visit/use of the Website, including by entering such data into a personal database. Your personal data are stored in compliance with the requirements of the effective laws in the field of personal data.

2.7. Your personal data are distributed exclusively upon your consent or in the cases determined by this Policy and the effective laws.

2.8. The Foundation takes all necessary measures to protect data from unauthorised access, modification, disclosure or destruction. Such measures include, in particular, internal review of data collection, storage and processing processes and security measures, including appropriate encryption and physical data security measures to prevent unauthorised access to the systems in which we store personal data.

3. TERM OF STORAGE OF PERSONAL DATA

3.1. Personal data are stored for no longer than it is necessary in accordance with the purpose of their processing.

4. RIGHTS OF PERSONAL DATA SUBJECTS

4.1. Users/visitors of the Website as personal data subjects have the following rights under the law:

• to receive from the Foundation information not specified in this Policy regarding the processing, conditions of providing access to your personal data, or to give an appropriate assignment to receive such information by persons authorised by you, except for the cases determined by the law;

• to have free access to their personal data;

• to receive a response to the request regarding the processing of your personal data in the manner and within the time frames determined by the effective laws;

• to submit a reasoned claim with an objection to the processing of your personal data, or regarding the change or destruction of your personal data, if such data are processed illegally or are unreliable;

• to protect their personal data from illegal processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision of data, as well as protection from providing information that is unreliable or disgraces the honour, dignity and business reputation of a natural person;

• to withdraw their consent to the personal data processing, and to exercise other rights defined by the effective laws in the field of personal data protection.

5. CHANGES IN THE PRIVACY POLICY

5.1. The Foundation reserves the right to change this Privacy Policy at any time without a prior notice. The user/visitor should check this Policy from time to time to ensure that the user/visitor agrees with any changes to this Policy.
